Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you (whether individually or on behalf of an enterprise or entity, "User", "You") and BidsPilots Ltd. ("BidsPilots", "We", "Us", or "Our"), governing your access to and use of the BidsPilots platform, web application, mobile applications, APIs, and tender discovery tools located at bidspilots.in.

By accessing our website, creating an account, initiating a subscription, or using any BidsPilots service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to all terms, you must immediately discontinue use of the platform.

BidsPilots operates a digital SaaS intelligence and notification engine designed for contractors, suppliers, vendors, and businesses participating in public procurement across India. Key platform capabilities include:

• Live GeM Tender Aggregation: Centralized aggregation and indexing of active public tenders, bids, and BOQ requirements.
• Fast Search & Filter Dimensions: Sub-15 millisecond in-memory searching by Ministry, Department, Organization, State, City, Category, and Estimated Value.
• Automated Match Engine: Algorithmic matching between user-saved criteria and newly published tenders using high-performance query architectures.
• WhatsApp Tender Alerts: Real-time delivery of matched tender summaries and deadline reminders directly to registered WhatsApp numbers.
• Bid Tracking & Notes: In-platform tracking tools to organize candidate bids, submission deadlines, and internal team audit notes.

All government tenders, bid notices, BOQ specifications, and department documents indexed on BidsPilots are obtained from publicly accessible official government portals. While BidsPilots undertakes continuous efforts to maintain high accuracy and latency below 15ms, procurement notices, deadlines, and technical specifications are subject to official corrigenda, amendments, and updates on the source government portal.

Users are strictly advised to review the authoritative official bid documents directly on the official GeM portal (gem.gov.in) before submitting bids, earnest money deposits (EMD), or legal tenders.

To access specialized features, save customized filters, or receive WhatsApp alerts, you must register an account by providing an authentic email address and active mobile number. You agree to:

• Provide true, accurate, and current business registration information during sign-up.
• Authenticate your account via our secure dual-channel One-Time Password (OTP) dispatched to your email and WhatsApp.
• Maintain the absolute confidentiality of your account credentials and passwords.
• Immediately report any unauthorized access or security breach to bidspilots@gmail.com.
• Refrain from pooling, reselling, or sharing individual account logins with external parties or third-party organizations.

BidsPilots integrates direct WhatsApp messaging to deliver essential operational notifications. By registering your mobile number, you explicitly grant consent for BidsPilots to deliver:

• Mandatory Authentication Messages: 6-digit verification OTPs for sign-up, login verification, and forgot-password resets.
• User-Configured Tender Alerts: Notifications whenever an active GeM tender matches your saved business filters or target keywords.
• Deadline & Expiry Warnings: Time-sensitive alerts notifying you of impending bid submission deadlines.
• Billing & Subscription Notices: Invoices, payment confirmations, and account renewal reminders.

We do not send unsolicited third-party marketing advertisements over WhatsApp. You may adjust your WhatsApp notification preferences or mute tender alerts at any time via your Account Settings.

BidsPilots provides both complimentary trial access and premium recurring subscription plans (Monthly, Quarterly, Half-Yearly, and Annual). Premium tiers unlock expanded filter slots, unlimited WhatsApp match notifications, and prioritized indexing.

• Payment Processing: Online payments are processed through Razorpay Software Private Limited ("Razorpay"), an authorized Reserve Bank of India (RBI) payment aggregator.
• Card Data Security: BidsPilots never stores raw credit/debit card numbers, CVVs, or banking PINs on its servers. All payment transactions comply with PCI-DSS standards.
• Taxes: All applicable Goods and Services Tax (GST) is calculated and displayed transparently prior to checkout. Tax invoices are automatically generated upon payment success.

You may cancel your subscription at any time through your Account Settings or by contacting customer support. Cancellation prevents future billing cycles while permitting full access until the expiration of your currently active paid period.

Due to the high-velocity, digital nature of public tender intelligence data and immediate server indexing allocations, subscriptions are generally non-refundable once activated. However, refund requests submitted within 7 days of initial subscription purchase where an unexpected technical error prevented service delivery will be evaluated in good faith by our billing team. Approved refunds are processed back to the original payment source within 5 to 7 business days via Razorpay.

The BidsPilots brand, logo, platform architecture, matching algorithms, user interface designs, and indexing code are the proprietary intellectual property of BidsPilots Ltd. You agree NOT to:

• Deploy automated scrapers, crawlers, data mining bots, or bulk extraction scripts against the BidsPilots website or APIs without prior written authorization.
• Attempt to reverse-engineer, decompile, or extract the source code or proprietary matching index algorithms.
• Circumvent API rate limits, authentication safeguards, or subscription interceptor gates.
• Resell, redistribute, or white-label BidsPilots alerts or data feeds to commercial third parties.

The platform and all tender information are provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied. BidsPilots does not guarantee that any tender notification will result in a contract award or successful bid.

To the maximum extent permitted under applicable law, BidsPilots Ltd. and its directors, employees, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of business, lost profits, or missed bidding deadlines resulting from portal delays, network failures, or source government portal outages. Our aggregate liability for any direct claim arising from your use of the platform shall not exceed the total subscription fees paid by you to BidsPilots during the twelve (12) months preceding the event.

These Terms and any contractual or non-contractual disputes arising from your use of the BidsPilots platform shall be governed by and construed in accordance with the laws of the Republic of India.

Any legal dispute, action, or proceeding arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts situated in Pune, Maharashtra, India.
